1. The Challenge is run by The Sleep Boss (ABN 59583421712), trading as ‘the SleepBoss’ (‘Promoter’) of PO Box 3140, Prahran VIC 3181.
2. The Free 7 Day Sleep for Success Challenge (‘Challenge’) is a promotion that seeks to increase your journey to better sleep and overall improved health and wellbeing. It seeks to encourage users to actively engage in our website and to promote awareness of the benefits of natural products in improving sleep.
3. Information on how to join and the details of all activities form part of these Terms and Conditions. Participation in this Challenge is deemed acceptance of these Terms and Conditions.
4. Entry is open to all residents in Australia and New Zealand (“Entrants”). Should any dispute arise in relation to these terms and conditions the jurisdiction of the State of Victoria exclusively applies. Entrants under 18 years of age must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter/Provider to enter into a further agreement as evidence of consent to the minor entering this challenge.
5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion, are ineligible to enter.
6. The Promoter/ Provider reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). In addition, the Promoter reserves the right to request the user to provide proof of identity, age and proof of residency at the address.
7. The Promoter reserves the right to disqualify any entrant who submits an entry that is not accordance with these Terms and Conditions.
8. The promotion commences at the time of entry to the challenge. All times stated in these Terms and Conditions are based on Melbourne time (AEST).

HOW TO ENTER

1. To enter, sign up on our website by visiting the page Free 7 Day Sleep for Success Challenge.
2. The Entrant will receive a series of daily recommendations, by email, of what to do each day during the challenge over a seven day period.
3. The Promoter/Provider will collect the Entrant’s personal information, including the Entrant’s name, likeness, email address and social media account details. The purpose of collecting this information, will allow the Promoter/Provider to collect the Entrant’s data to store on an electronic database to send through future promotional, publicity and marketing material; and also contain contact information. The Entrant consents to such a use.
4. When an Entrant submits any materials in response to prompts in the challenge including comments and photos (“Content”), these submissions become property of the Promoter/Provider  and it is a condition of entry that the Content may be used by the Promoter/Provider for their own marketing, promotional materials and publicity purposes without restriction. Entrants warrant that they have full authority to grant these rights, will not make any moral objection to the use of the Content and will not seek compensation.

ENTRANTS WARRANTIES:

1. Entrants warrant and agree that:

• they will seek the approval of medical practitioners if they have allergies or medical concerns regarding any products or activities, prior to competing in the Challenge;
• they will not rely on the daily tasks suggested by the Challenge as medical advice;
• their content shall not cause injury or harm to any person, or contain viruses to any object;
• they will not submit any Content that is false or illegal, or that breaches any privacy, intellectual property, publicity or other rights of any person;
• an Entrant’s submitted content will not be untrue and will not impersonate another person;
• they will not submit any Content that is inappropriate for publication. For example, Content will not be abusive, defamatory, sexually inappropriate, or offensive with respect to sexual identity, heritage, religion, disability, race, gender;
• if an Entrant has mutually crafted a submission with another person/s, they will obtain prior consent from that person or persons who has or have assisted in the submission or has or have any interests or rights in the Content, before submitting to the Challenge;
• they will follow all relevant regulations and laws, including, those covering publicity, defamation, copyright, privacy, and the use of others’ computer or other electronic devices or communication systems in Australia.

14. The Promoter may remove any Content without notice for any reason.

15. Entrants consent to the Promoter using their name, and image in the event they use any content on their website from a period of (12) months from end of the Challenge without payment, for the purposes of endorsing this promotion (including any outcome), and promoting any products dispersed, manufactured, and/or supplied by the Promoter.

16. ThePromoter/Provider reserves the right, in its sole discretion, to terminate, suspend, change or cancel the promotion without notice.

17. Any cost associated with accessing the promotional website is the Entrant’s responsibility. If any automated software is used to submit multiple entries, then these submissions will be prohibited and all entries submitted by that Entrant will be made invalid.

18. Without limiting any other terms herein, the Entrant agrees to indemnify thePromoter/Provider in respect of any loss incurred as a result of the Entrant’s breach of any of the above terms.

19. To the extent permitted by law, the Promoter is not responsible or liable for loss to any person that arises out of:

20. Any side-effects that might arise from consumption of the products; If in the course of participating in the challenge, injury or loss is sustained to any persons or property;

• Purported entries that are not received;
• Being unable to access or use the website or service;
• Unpermitted human interference in any part of the challenge;
• Any damage to a persons property that has resulted from participation, or downloading of materials in relation to this challenge.
• Injury or loss sustained to any persons or property in the course of participating in any activity.

21. Failure by the Promoter/Provider to enforce any of its rights at any stage does not constitute a waiver of those rights.  

DECISION FINAL

22. In all matters, all decisions made by The Sleep Boss panel will be final and cannot be contested. No correspondence or discussions will be entered into.
